Louis v. BCG Equities, LLC, 2024 WL 4310458 (S.D. Fla. Sept. 25, 2024)


If BCG Equities, LLC (“BCG”) filed a lawsuit against you in a Florida court between June 21, 2023 and August 2, 2024, you may benefit from the settlement of this class action lawsuit.
 
A consumer sued BCG alleging that it filed lawsuits against consumers in Florida even though it was not registered as a consumer collection agency with the State of Florida Office of Financial Regulation, in violation of the federal Fair Debt Collection Practices Act. BCG expressly denies any liability, or that it violated the law, but has agreed to a settlement to avoid the expense and uncertainty of continued litigation.
 
A settlement will provide $6,500 (the “Settlement Fund”) to fully settle and release claims of a class of persons who BCG sued in a Florida court between June 21, 2023 and August 2, 2024 in connection with the collection of a consumer debt. The Settlement Fund created by BCG will be used to pay pro-rata settlement awards to all participating class members. If all class members participate, it is anticipated each person will receive approximately $98.
 
BCG separately will pay statutory damages to the named plaintiff, class counsel’s attorneys’ fees, costs, and expenses, as well as the costs of notice and administration of the settlement.
 
The Court granted preliminary approval to the settlement on September 25, 2024. The Court will hold a final fairness hearing on January 10, 2025. Class members are not required to attend this hearing.  If the Court approves the settlement following the January 10, 2025 hearing, class member payments will be mailed within 60 days after such approval.
