If Persolve Recoveries, LLC (“Persolve”) filed a lawsuit against you in a Florida court between February 16, 2020 and February 9, 2021, you may benefit from the settlement of this class action lawsuit.
A consumer sued Persolve alleging that it filed lawsuits against consumers in Florida even though it was not registered as a consumer collection agency with the State of Florida Office of Financial Regulation, in violation of the federal Fair Debt Collection Practices Act. Persolve expressly denies any liability, or that it violated the FDCPA, but has agreed to a settlement to avoid the expense and uncertainty of continued litigation.
A settlement will provide $20,000.00 (the “Settlement Fund”) to fully settle and release claims of a class of persons who Defendant sued in a Florida court between February 16, 2020 and February 9, 2021 in connection with the collection of a consumer debt.
The Settlement Fund created by Defendant will be used to pay pro-rata settlement awards to all participating class members. Defendant separately will pay statutory damages to the named plaintiff, class counsel’s attorneys’ fees, costs, and expenses, as well as the costs of notice and administration of the settlement.
The Court granted preliminary approval to the settlement on October 17, 2022.
The deadline for any class member to submit a claim, request exclusion from the settlement, or file an objection is December 16, 2022.
The Court will hold a final fairness hearing on February 6, 2023, at 11:00 a.m. The hearing will take place in the United States District Court for the Southern District of Florida, U.S. Federal Building and Courthouse, 299 East Broward Boulevard, Courtroom 207A, Fort Lauderdale, FL 33301. At the final fairness hearing, the Court will consider whether the settlement is fair, reasonable, and adequate and, if so, whether it should be granted final approval. The Court will hear objections to the settlement, if any. The Court may make a decision at that time, postpone a decision, or continue the hearing.
