Knapper v. Cox Communications, Inc., 329 F.R.D. 238 (D. Ariz. 2019)


On February 6, 2019, the District of Arizona certified the following class:

"(1) all persons and entities throughout the United States, (2) to whom Cox Communications, Inc. placed a call (3) directed to a number assigned to a cellular telephone service, but not assigned to a Cox Communications, Inc. subscriber, (4) in connection with its efforts to collect a past due residential account balance, (5) via its Avaya dialers or with an artificial or prerecorded voice, (6) from March 28, 2013 through the date of class certification."

The Court also "appoint[ed] the law firm of Greenwald Davidson Radbil PLLC as class counsel pursuant to
Rule 23(g)."
